Portland's delivery app fee cap: 15% for delivery, 4% for takeout

Updated October 20, 2026

Last updated: 20 October 2026. Read from Portland City Code chapter 7.27, Regulation of Third-Party Food Platforms, and Ordinance 191126.

Portland, Oregon caps what a third-party food platform can charge a restaurant at 15% of the order's menu price for delivery and 4% for takeout. On orders under $10 the 15% doesn't apply, but the delivery fee can't exceed $1.50. A platform may sell higher-priced plans only if it offers every restaurant 15% delivery and 4% takeout options without requiring other purchases. The permanent rules took effect on 1 March 2023, replacing the 2020 temporary cap.

In short

  • Delivery: at most 15% of the purchase price (menu price, without tax, tips and other fees); orders under $10 at most $1.50.
  • Takeout: at most 4%.
  • Card processing: passed on only at what the processor actually charges, stated in the contract.
  • Higher plans: allowed only alongside 15%/4% options, with written notice in each language spoken by about 1,000 or more residents with limited English.
  • Penalty: up to $1,000 per violation, at most $1,000 per restaurant per day, enforced by the City's Revenue Division.

What does Portland's code say?

RulePortland City Code ch. 7.27
Delivery cap15% of the purchase price per order (7.27.020 D)
Small ordersThe 15% cap doesn't apply under $10; a maximum fee of $1.50 may be charged instead
Takeout cap4% of the purchase price per order (7.27.020 E)
Card processingA transaction fee passed on at the processor's own charge, stated in the contract, with proof on request (7.27.020 F)
ExemptionThe caps don't apply to a platform that offers all restaurants delivery at 15% or less and takeout at 4% or less without other required purchases, charges more only for extra services, and notifies existing restaurants in writing in each language spoken by about 1,000 or more limited-English residents (7.27.020 G)
No penalty for the capped planA platform can't refuse delivery or takeout orders because a restaurant chose only the capped services (7.27.020 H)
ContractsWritten agreement before listing; each fee clearly defined (7.27.020 A, I)
Ending a contractWithin three business days of the restaurant's notice
Phone ordersNo fee for a call that doesn't result in a transaction during the call (7.27.020 M)
PenaltiesUp to $1,000 per violation, capped at $1,000 per restaurant per day, plus restitution; restaurants and drivers may also sue (7.27.040)
EnforcementThe City Administrator, delegated to the Revenue Division (7.27.030)

What it means on real orders

OrderMost a platform can charge on the capped optionsEffective rate
$30 delivery$4.50, plus card processing at cost15%
$8 delivery$1.5018.75% (the $1.50 small-order limit)
$30 takeout$1.20, plus card processing at cost4%
$30 delivery on a 30% plan sold alongside the capped options$9.0030%

Worked example: a Division Street café takes 300 app orders a month: 150 deliveries at $30, 100 takeout orders at $30 and 50 small deliveries at $8 (coffee and a pastry). On the capped options it pays at most 150 × $4.50 + 100 × $1.20 + 50 × $1.50 = $870 a month before card processing. On a 30% plan for everything it would pay $2,370.

Uber Eats lists a 15% Lite delivery rate and a 4% Lite pickup rate in Portland, matching the city's two caps (20% and 7% in most of the US). See Uber Eats commission in the US.

How the permanent rules replaced the 2020 cap

Portland's 2020 temporary cap limited platforms to 10% for delivery and 5% for takeout and was extended to 28 February 2023. Ordinance 191126, passed 5–0 on 4 January 2023, added chapter 7.27 to the City Code from 1 March 2023 with the current 15% delivery and 4% takeout caps.

How to report a problem

The Revenue Division of the City Administrator's office enforces chapter 7.27. Each order processed in violation is a separate violation, and restaurants can also go to court for damages.

Portland caps apps at 15% and 4%; your own page charges no commission on either. See the.
