Tax-inclusive pricing: when the tax is already in the menu price
Updated October 20, 2026
Tax-inclusive pricing means the price on the menu already contains the tax. A coffee listed at $4.00 costs $4.00 at the register, and the tax is worked out from inside that price instead of being added on top. The opposite, tax-exclusive pricing, lists $3.70 and adds the sales tax at checkout.
In short
- Tax-exclusive: price + tax = what the guest pays. Most US menus work this way.
- Tax-inclusive: the price is what the guest pays; the tax inside it = price × rate ÷ (100 + rate).
- In the US, check your state first. Some states restrict tax-included pricing; a Virginia ruling allows it "only in very limited situations."
- On Menuthere you mark each dish Tax Inclusive or not, and the bill never charges the tax twice.
Tax-inclusive vs tax-exclusive
| Tax-exclusive | Tax-inclusive | |
|---|---|---|
| Menu shows | $10.00 | $10.80 |
| Tax (8%) | $0.80 added at checkout | $0.80 already inside |
| Guest pays | $10.80 | $10.80 |
| Restaurant keeps before tax | $10.00 | $10.00 |
| Why restaurants choose it | The usual US way; prices look lower | Round prices; no surprise at the register |
How to find the tax inside a price
Tax inside = price × rate ÷ (100 + rate)
At 8%, a $10.80 dish holds 10.80 × 8 ÷ 108 = $0.80 of tax; the net price is $10.00. A common mistake is to take 8% of $10.80 ($0.86), which overstates the tax.
To set a tax-inclusive price that keeps your net price, multiply: net price × (1 + rate). A $3.70 coffee at 8% becomes $4.00 (3.70 × 1.08 = 3.996).
Can US restaurants include sales tax in menu prices?
It depends on the state, and sometimes the city. Sales tax rules are set by each state, and some require the tax to be stated separately on the receipt. For example, a 1998 ruling of the Virginia Tax Commissioner (Ruling 98-20) said Virginia law "allows the inclusion of the sales tax within the selling price only in very limited situations," with the Commissioner's permission, and that the tax amount must appear separately on the sales record. Ask your state's tax department before switching a US menu to tax-included prices.
A worked mixed bill
A café marks drinks Tax Inclusive and leaves food tax-exclusive. The rate is 8%.
| Item | Menu price | Tax | Line total |
|---|---|---|---|
| Latte (tax inclusive) | $5.40 | $0.40 inside | $5.40 |
| Bagel (tax on top) | $4.00 | $0.32 added | $4.32 |
| Bill | Sales tax $0.32 shown | $9.72 |
The guest pays $9.72. Only the tax that was added shows as a line; the $0.40 inside the latte isn't added again. (Illustrative prices.)
How Menuthere handles tax-inclusive prices
- Per dish. In the dish editor, Tax Inclusive is described as "Price already includes GST/VAT." With it on, the price isn't increased; the tax inside it is worked out and not added again.
- Mixed carts. Menuthere adds tax on dishes without the mark and takes it out of the price of dishes with it. When every dish on the bill is tax inclusive, checkout shows an information row such as VAT (included) that isn't added to the total; when anything is taxed on top, only the added tax shows, so a guest never sees two tax lines.
- Your tax and its name. Switch on Charge tax on orders and set the Tax percentage. Outside India the line takes your country's usual name: Sales tax in the US, VAT in the UK, Europe, South Africa and the Gulf, GST in Australia, New Zealand, Singapore and Canada, SST in Malaysia, or a name you type.
- Different rates per dish. Outside India a dish can have its own rate, such as 0% for food taxed at a lower rate, and the bill shows a line per rate. Past orders keep the rates they were charged at.
- On every plan. Help: tax, GST and VAT and delivery prices and tax-inclusive prices.
What it doesn't do: Menuthere doesn't look up your local sales-tax rate or file tax returns. You enter the rate; check it with your state or local tax authority.
Set your tax once and mark the dishes that already include it.

FAQs
What does tax-inclusive pricing mean?
It means the listed price already contains the tax, so the customer pays exactly the price shown. The tax is worked out from inside the price rather than added at checkout.
How do I calculate the tax in a tax-inclusive price?
Multiply the price by the tax rate and divide by 100 plus the rate. At 8%, a $10.80 price contains 10.80 × 8 ÷ 108 = $0.80 of tax, leaving a net price of $10.00.
Can a US restaurant include sales tax in its menu prices?
It depends on the state. Some states require sales tax to be stated separately; a Virginia Tax Commissioner ruling says Virginia allows tax-included pricing only in very limited situations, with permission. Check with your state's tax department first.
Will customers be charged tax twice on a tax-inclusive dish?
Not on Menuthere. A dish marked Tax Inclusive is not taxed again at checkout. If every dish is tax inclusive, the bill shows the included tax as an information line that isn't added to the total.
Can some dishes include tax and others not?
Yes. On Menuthere the Tax Inclusive mark is set per dish, and a bill can mix both kinds. Tax is added only on the dishes without the mark.
