Can I add a card fee or surcharge to online food orders?
Updated 6 October 2026
It depends on the country. Card surcharges are banned in the UK and the EU, and India's RBI says merchants must not pass debit card charges on to customers.
- UK and EU: card surcharges are banned, in the UK since 13 January 2018 and in the EU where both banks are in the EEA.
- India: banks must make sure merchants do not pass debit card charges (MDR) on to customers.
- USA: Visa allows credit card surcharges only, in most states, capped at your cost or 3%, with notice and disclosure.
- Australia: the RBA is removing surcharging on debit, prepaid and credit cards, with most changes from 1 October 2026.
Cover payment fees without a surcharge
Menuthere takes no commission and no per-order fee. Payment gateway fees go from the gateway to your own account, so you can price your menu and delivery fee to cover them.
